OpenAI has urged California Governor Gavin Newsom to strengthen SB 53, the state frontier AI transparency law passed in 2025, in a letter dated October 20, 2026 signed by Chan Park, OpenAI head of US and Canada policy and partnerships. The company recommends requiring developers to monitor models for dangerous behavior during training and evaluation, improve cybersecurity protections, notify affected parties of covered cyber incidents, establish effective shutdown controls for unsafe systems, and undergo independent audits to verify compliance and safety requirements.

OpenAI also supports requiring that safety frameworks explicitly cover the ability of frontier models to conduct AI research and development autonomously. SB 53 currently requires frontier companies to publish safety frameworks and transparency reports and to report major safety incidents. StateScoop notes the letter builds on OpenAI support for strengthening SB 53 stated over the summer, and that Newsom signed two bills last month creating a framework for independent verification organizations and a state registry for AI auditors.
