   23rd Oct 2026

The US Securities and Exchange Commission said on October 23, 2026 that artificial intelligence will be a priority area for its Division of Examinations in fiscal 2027, the federal fiscal year that began October 1, 2026. In Press Release No. 2026-109 and its priorities statement, the division said examiners will focus on firms' use of AI and other technology that may affect market operations, compliance, fraud prevention and investor protection, using the term super intelligence, which did not appear in the fiscal 2026 priorities. The wider priority list includes private funds and private credit, protection of retail investors in complex or higher risk products, and tokenized securities and other evolving market infrastructure.

The division covers more than 34,000 regulated entities, including investment advisers, broker dealers, clearing agencies and exchanges, and examination findings can be referred to the enforcement division. The priorities are guidance on examination focus, not a new rule, and the division says the list is not exhaustive and may be adjusted during the year.
