Colorado replacement AI law reaches its rulemaking deadline

Colorado's replacement AI law reaches its rulemaking deadline today, October 26, 2026. Colorado repealed SB 24-205 before it took effect and replaced it with SB 26-189, signed May 14, 2026, which applies to consequential decisions made on or after January 1, 2027. The Attorney General's formal rulemaking hearing on the proposed rules (4 CCR 904-6) is today in Denver, and written comments close at 11:59 PM Mountain Time.

The duties the rules implement are decision level: pre-use notice to consumers, a plain language disclosure within 30 days of an adverse outcome, data correction, meaningful human review with authority to override, and three year record keeping. A federal court order in xAI v. Weiser bars the Attorney General from initiating enforcement until at least 14 days after the court rules on xAI's forthcoming preliminary injunction motion.
